Privacy Notice

This notice describes how BERS AI LLC collects, uses, retains, and protects information in connection with its Behavioral Enhanced Risk Scoring platform and how individuals may exercise their rights.

Who we are

BERS AI LLC — Behavioral Enhanced Risk Scoring

BERS AI LLC ("BERS," "we," "us") operates a behavioral analysis platform that produces dimensional risk scores for institutional operators in permissible-purpose contexts defined by the Fair Credit Reporting Act. BERS operates as a consumer reporting agency as defined in 15 U.S.C. § 1681a(f). Our registered place of business is in the State of Delaware.

This Privacy Notice applies to information processed by BERS in connection with its products, website (bersapp.com), and access management system. It does not apply to information processed by institutional operators who use BERS products — those operators maintain their own privacy and data-handling obligations with respect to consumers whose information they submit to BERS for analysis.

What we process

Information We Collect and Use

BERS processes the following categories of information in connection with its platform:

Operator-submitted inquiry data. When an institutional operator submits an inquiry to a BERS product, the operator provides identifying information about the individual being assessed. This data is processed to generate the behavioral analysis output and is retained as described under Retention below.

Behavioral signal data. BERS analyzes behavioral patterns using the data architecture defined for each product. This analysis is conducted by BERS's scoring engine and is not disclosed to third parties except as required to fulfill the inquiry or as required by law.

Operator account information. BERS collects contact, professional, and institutional information from individuals who apply for and maintain operator access, including name, title, institutional affiliation, and business email. This information is used to manage the operator relationship and to fulfill regulatory obligations.

Website and access system information. BERS collects standard server log data in connection with access to bersapp.com, including IP addresses, browser type, and access timestamps. This data is used for security monitoring and platform integrity, and is not used for behavioral analysis or sold to third parties.

Permissible purpose

Why We Process This Information

BERS processes information exclusively in connection with permissible purposes defined by the Fair Credit Reporting Act and applicable law. Each BERS product operates under a specific permissible purpose class. BERS does not use consumer information for marketing, advertising, data brokerage, or any purpose outside its defined analytical functions.

Operators are responsible for certifying a permissible purpose for each inquiry they submit. BERS does not process inquiries for which no permissible purpose has been certified.

No Sale of Consumer Data. BERS does not sell, license, or broker consumer information. BERS analysis outputs are licensed solely to the operator who submitted the inquiry, for use within that operator's own decisioning infrastructure. BERS outputs may not be resold or redistributed.

Consumer rights

Your Rights Under the FCRA and Applicable Law

As a consumer reporting agency, BERS is subject to the Fair Credit Reporting Act and must honor consumer rights established under that law. The following rights apply to individuals whose information BERS has processed in connection with a consumer report.

Right to Disclosure

You may request disclosure of the nature and substance of information in your BERS consumer report. BERS will provide this disclosure in accordance with FCRA § 609.

Right to Dispute

You may dispute the accuracy or completeness of any information in a BERS report. BERS will conduct a reinvestigation as required by FCRA § 611.

Right to Source Disclosure

If you received an adverse action notice, you have the right to know the name and address of the consumer reporting agency that furnished the report.

State Privacy Rights

Residents of certain states (including California, Colorado, Virginia, Connecticut, and others) may have additional rights under applicable state privacy law. Contact privacy@bers.ai for details.

To exercise any of the rights above, contact BERS at privacy@bers.ai with a description of your request and, where applicable, a copy of the adverse action notice that identified BERS AI LLC as a source.

Data security

How We Protect Information

BERS maintains administrative, technical, and physical safeguards designed to protect consumer information from unauthorized access, disclosure, alteration, and destruction. Access to consumer inquiry data and analysis outputs is restricted to authorized personnel and systems operating within the BERS platform. BERS employs encryption in transit and at rest, access controls, and security monitoring appropriate to the sensitivity of the information processed.

BERS limits access to consumer information to the operator who submitted the original inquiry and to BERS personnel responsible for generating and validating the analysis. Analysis outputs are not accessible to other operators or to third parties except as required by law.

Retention

How Long We Keep Information

BERS retains consumer inquiry records and analysis outputs for a period sufficient to fulfill regulatory obligations under the Fair Credit Reporting Act, including FCRA § 607(b) record-retention requirements applicable to consumer reporting agencies. BERS does not retain consumer information beyond the period necessary to fulfill its regulatory and contractual obligations.

Operator account information is retained for the duration of the operator relationship and for the period required to fulfill post-termination regulatory and legal obligations. Website access logs are retained for security monitoring purposes in accordance with BERS's internal security policy.

Changes to this notice

Updates and Revisions

BERS may update this Privacy Notice from time to time to reflect changes in our practices, applicable law, or platform capabilities. Material changes will be posted to bersapp.com with an updated effective date. Operators will be notified of material changes to privacy practices that affect their obligations under the Operator Agreement.

Continued use of BERS products by an institutional operator after notice of a material change constitutes acceptance of the updated practices, subject to the terms of the Operator Agreement.
